Terms & Conditions of Hire and Purchase
 

These Terms & Conditions apply to all Christmas tree hire, festive styling, installation, collection and bespoke purchase services supplied by Christmas Tree Hire Sunshine Coast.
 

By confirming a booking and paying the required deposit, the client agrees to these Terms & Conditions.
 

1. Bookings & Payment
A 50% deposit is required to secure the booking, installation date and selected package. A booking is not confirmed until the deposit has been received.

The remaining balance is due 14 days prior to the scheduled installation date.

Bookings made within 14 days of installation require payment in full at the time of confirmation.

Christmas Tree Hire Sunshine Coast reserves the right to release an installation date or selected package where the required payment has not been received by the due date.

Payment of the deposit constitutes acceptance of these Terms & Conditions.
 

2. Hire Period

The hire period will be specified in the client’s quote or booking confirmation.

All hire items remain the property of Christmas Tree Hire Sunshine Coast throughout the hire period and must remain at the installation address until collection unless otherwise agreed in writing.
 

3. Ownership of Hire Items

All items supplied as part of a hire package remain the property of Christmas Tree Hire Sunshine Coast.

This includes, but is not limited to, Christmas trees, lights, baubles, ornaments, ribbon, florals, decorative picks, garlands, wreaths, gift boxes, tree toppers, accessories and other styling items.

Hire items must not be sold, transferred, disposed of or removed from the premises.


4. Installation & Site Access

The client is responsible for providing safe and reasonable access to the installation area at the agreed time.

The client must advise Christmas Tree Hire Sunshine Coast before installation of any relevant access issues, including stairs, lifts, loading restrictions, parking requirements, security procedures, restricted access or unusually difficult installation conditions.

The installation area must be cleared and reasonably ready for installation.

Where delays or additional work arise because suitable access has not been provided, reasonable additional labour, equipment or attendance charges may apply.

The client or an authorised representative should be available where reasonably required to provide access and approve positioning.
 

5. Tree Placement

Christmas Tree Hire Sunshine Coast will position and install hired items in the agreed location.

Once professionally installed, trees and other hire items must not be moved, dismantled, altered or restyled by the client or any third party without prior approval.

Moving or altering an installed tree can affect its stability and may result in damage to the tree, decorations or surrounding property.

The client may be responsible for reasonable repair, replacement or additional attendance costs resulting from unauthorised movement or alteration.
 

6. Client Responsibility

The client must take reasonable care of all hired items while they are on the premises.

The client should notify Christmas Tree Hire Sunshine Coast as soon as reasonably possible if an item becomes damaged, unstable, faulty, lost or stolen.

Any damaged components should be retained for inspection where practical.

The client is responsible for damage, loss or theft caused by misuse, negligence, unauthorised movement, deliberate acts, or the actions of the client, guests, staff, contractors or other persons at the premises.

Normal wear and tear associated with reasonable use is excluded.
 

7. Damage, Loss & Theft

Where hired items are damaged beyond reasonable wear and tear, lost or stolen, the client may be charged the reasonable cost of repair or replacement.

Where theft or vandalism occurs, Christmas Tree Hire Sunshine Coast may request a police event or report number where reasonably necessary for insurance or assessment purposes.

Any charges will reflect the nature of the damage or loss and the reasonable cost of rectification or replacement.


8. Electrical Safety

Where lighting is supplied, the client must provide access to a suitable, safe and functioning electrical outlet.

The client must ensure electrical outlets and any client-supplied extension leads are in safe working condition.

Lighting, cables and electrical components supplied by Christmas Tree Hire Sunshine Coast must not be modified, relocated, disconnected or altered without approval.

The client must notify Christmas Tree Hire Sunshine Coast promptly if any electrical fault or lighting issue occurs.
 

9. Fixings & Installation Requirements

Some installations may require temporary fixing points, supports or other securing methods to ensure the display is installed safely.

Where drilling or other permanent fixing methods are required, client approval will be obtained before the work is carried out.

Christmas Tree Hire Sunshine Coast will take reasonable care when installing and removing approved fixing points. Minor marks consistent with an approved installation may occur and should be discussed before installation where relevant.
 

10. Collection & Pack-Down

Christmas Tree Hire Sunshine Coast will arrange collection at or around the agreed end of the hire period.

Hire items must remain accessible and in their installed location until collection unless otherwise agreed.

The client must provide reasonable access for pack-down and collection.

Additional charges may apply where collection is delayed or prevented by circumstances within the client’s control.
 

11. Additional Attendance

Where Christmas Tree Hire Sunshine Coast is required to return to the property because of circumstances outside the original agreed scope — including unauthorised movement, client-requested changes, access issues or damage — reasonable additional labour, travel or equipment charges may apply.

Any significant additional charges will be communicated to the client wherever reasonably practicable.
 

12. Cancellations & Changes

Cancellation requests must be made in writing.

Where a booking is cancelled, any refund or amount retained will take into account the timing of the cancellation and reasonable costs already incurred, including preparation, administration, stock specifically ordered or allocated, styling work completed and other commitments made for the booking.

Where custom or specially ordered items have already been purchased for a client, those costs may not be refundable.

Christmas Tree Hire Sunshine Coast will act reasonably when assessing any cancellation amount and nothing in these Terms excludes rights available under Australian Consumer Law.

Requests to change installation dates, tree sizes, collections or styling are subject to availability and may affect the quoted price.
 

13. Bespoke Purchase Packages

The Bespoke Purchase Collection is a purchase service rather than a seasonal hire service unless otherwise stated in writing.

Trees, decorations and styling pieces specifically identified as purchased items become the client’s property once payment has been made in full.

Custom or specially ordered items may not be refundable where they have been ordered specifically for the client, except where required by Australian Consumer Law.

Delivery, installation, styling, pack-down or storage services may be quoted separately where applicable.

Items supplied as hire items alongside a bespoke purchase package remain the property of Christmas Tree Hire Sunshine Coast and must be returned at the end of the hire period.
 

14. Product Availability & Substitutions

Christmas styling products are subject to availability.

Where a particular decorative item becomes unavailable, Christmas Tree Hire Sunshine Coast may substitute an item of similar style, quality and value while maintaining the overall agreed design aesthetic.

Any material changes to the agreed design will be discussed with the client where reasonably practicable.
 

15. Photography

Christmas Tree Hire Sunshine Coast may photograph completed installations for portfolio, website and social-media purposes.

Where an installation is in a private residence or where identifiable personal information may appear, permission should be obtained before publishing identifiable material.

You could also make this an opt-in clause on your booking confirmation if you prefer.
 

16. Events Outside Our Control

Christmas Tree Hire Sunshine Coast will not be responsible for delays or inability to perform services caused by circumstances reasonably outside its control, including severe weather, unsafe site conditions, building-access restrictions, emergencies, transport disruption or other unforeseen events.

Where this occurs, reasonable efforts will be made to reschedule or provide an appropriate alternative.
 

17. Liability & Consumer Rights

Christmas Tree Hire Sunshine Coast will exercise reasonable care and skill in providing its services.

Nothing in these Terms & Conditions excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.

To the extent permitted by law, Christmas Tree Hire Sunshine Coast is not responsible for loss or damage caused by misuse, unauthorised alteration or movement of installed items, unsafe premises, client-supplied equipment, or the acts or omissions of third parties.
 

18. Insurance

Christmas Tree Hire Sunshine Coast maintains appropriate business insurance relevant to its operations.

Clients remain responsible for ensuring their own premises and activities are appropriately insured.

I would not state “full Workers Compensation Insurance with no outstanding liabilities” unless you have confirmed that statement is technically accurate for your exact business/employment structure.
 

19. Acceptance of Terms

Payment of the booking deposit or full booking amount confirms that the client has received, read and accepted these Terms & Conditions.
Email or written confirmation of acceptance may also constitute acceptance.
 

20. Governing Law

These Terms & Conditions are governed by the laws of Queensland, Australia.

Any dispute will be dealt with in accordance with applicable Queensland and Australian law.
